Moroccan tax authorities have introduced stricter requirements for companies declaring financial losses or zero profits, mandating them to submit detailed statements explaining the reasons behind such financial outcomes. Failure to comply may result in financial penalties, as stipulated by the country’s General Tax Code.

This measure is part of the tax administration’s broader effort to clamp down on potential tax evasion, particularly among small and medium-sized enterprises (SMEs) that have consistently reported losses.

Article 20 of the 2024 Tax Code requires companies to attach a statement, prepared in a standardized format issued by the tax administration, explaining their declared losses. Non-compliance triggers Article 198, which imposes a fine of 2,000 dirhams ($200) if the required statement is not submitted within 15 days of notification.

Suspicious Declarations Under Review

Tax inspectors have recently notified multiple companies—especially SMEs in sectors such as construction, tourism transport, and catering—about upcoming audits.

These businesses, primarily located in the Rabat-Casablanca corridor, have been flagged due to chronic financial losses. Initial audits have uncovered irregularities, including inflated expenses and manipulated revenue declarations aimed at evading tax liabilities.

“The requirement to submit a loss statement reflects the government’s intent to curb fraudulent accounting practices that drain state resources,” said Ibrahim Aswar, a chartered accountant based in Casablanca. He emphasized that tax evasion is not limited to large corporations but is also prevalent among SMEs, creating an unfair competitive environment for compliant businesses.

Under Article 232 of the Tax Code, tax obligations and penalties remain enforceable for up to ten years, even beyond the standard statute of limitations, provided that tax declarations were not filed. Experts anticipate that authorities will increasingly rely on data analytics and artificial intelligence to detect suspicious tax declarations.

To navigate the evolving tax landscape and avoid penalties, companies are advised to seek professional financial expertise. “Declaring losses raises immediate red flags for tax authorities, as it could indicate fraudulent activity,” said Amine Benrahmoun, a certified accountant and tax consultant. He urged companies facing legitimate financial difficulties to maintain transparent and well-documented financial records to substantiate their claims.

“Engaging certified accountants ensures compliance with both international and local accounting standards, reducing the risk of errors and penalties,” Benrahmoun added. He also emphasized that proper bookkeeping enhances financial transparency and enables timely submission of required documents, preventing fines and legal complications.

Furthermore, strategic tax planning can help businesses take advantage of available tax incentives while ensuring full legal compliance. “Tax non-compliance does not only result in financial penalties but can also lead to legal action, damaging a company’s reputation and business relationships,” Benrahmoun warned.
