American Airlines hit with a $50 million fine for failing to adhere to disability regulations.

The Department of Transportation has issued a significant $50 million fine against American Airlines for multiple serious violations concerning the treatment of passengers with disabilities. This penalty marks a historic move, being 25 times greater than previous fines for similar infractions, with the aim to establish a new precedent for how the Department addresses such issues.

Investigations conducted from 2019 to 2023 revealed instances of unsafe physical assistance that sometimes led to injuries, along with “undignified” treatment of wheelchair users and consistent failures to provide timely assistance. The Department also reported that numerous wheelchairs were mishandled, often resulting in damage or delays in returning them to passengers.

Outlined in the penalty, American Airlines will pay $25 million directly to the U.S. Treasury. They will also receive a credit of $25 million towards implementing initiatives designed to better handle wheelchairs, improve damage control, establish a comprehensive wheelchair tagging system, enhance coordination of wheelchair assistance, and compensate affected passengers. Should the airline fail to execute these improvements, they will be liable for an additional $25 million fine.

While American Airlines is highlighted as one of the primary offenders, the Department indicates that ongoing investigations are underway with other airlines as well. American Airlines reports a considerable improvement in their mishandling rate for wheelchairs—over a 36% drop compared to the previous years—and emphasizes a commitment to enhancing the overall experience for customers reliant on mobility devices.

Additionally, the Department of Transportation is taking further steps to protect passengers with disabilities. Proposed regulations aim to classify delays or mishandling of wheelchairs as automatic violations of federal law, streamlining the enforcement process. A recent rule mandates that airline bathrooms must be accessible to passengers with disabilities.

Traveling with disabilities has posed significant challenges, particularly with issues related to lost, damaged, or improperly handled wheelchairs. The Department noted a rise in mishandling incidents this year, with over 11,500 cases reported. In response, some airlines, like United, have introduced features to help passengers identify flights that can securely accommodate wheelchair travel.

This hefty fine and the ensuing regulatory actions reflect a focused effort to ensure that the rights and needs of passengers with disabilities are recognized and met by the airline industry.
